Las garantías de inversión sólo pueden concederse para proyectos subvencionables. Para ello, el proyecto debe utilizar el ECA alemán para promover las exportaciones alemanas. Además, la inversión en sus implicaciones ambientales, sociales y de derechos humanos debe ser segura. Se invita explícitamente a las empresas a cumplir con las Directrices de la OCDE para Empresas Multinacionales y los principios del Código Alemán de Sostenibilidad.
Para que se concedan garantías de inversión, también debe haber suficiente protección jurídica para la inversión en el país de inversión. Esto se da regularmente si existe un acuerdo de promoción y protección de inversiones entre Alemania y el país de inversión. Las decisiones son tomadas por un Comité Interministerial bajo los auspicios de BMWi y con la participación de expertos de la industria.
Las garantías de inversión sólo pueden concederse para nuevas inversiones. For this, the project must utilize the German ECA in order to promote German exports. In addition, the investment in its environmental, social and human rights implications must be safe. Companies are explicitly invited to comply with the OECD Guidelines for Multinational Enterprises and the principles of the German Sustainability Code.
In order to be granted investment guarantees, there must also be sufficient legal protection for the investment in the investment country. This is regularly given if there is an investment promotion and protection agreement between Germany and the investment country. The decisions are taken by an Interministerial Committee under the auspices of the BMWi and with the participation of experts from industry.
Investment guarantees can only be provided for new investments. The application for an investment guarantee must therefore be made before the investment is made.
